How to file — Lease renewal demand (stabilized)
Landlord (demand) → NYS HCR (complaint of failure to renew)
Deadline
Demand should issue within the 90- to 150-day pre-expiration window or shortly after
9 NYCRR § 2523.5 — owner must offer renewal 90–150 days before expiration. NYC Admin Code § 26-511(c)(4).
How to submit
MAIL
Send the renewal demand to your landlord (certified mail)
If the landlord missed the 90- to 150-day window, send a certified-mail demand citing 9 NYCRR § 2523.5.
ONLINE
NYS HCR — file Form RA-90 (Tenant Complaint of Failure to Renew Lease)

If the landlord still refuses after demand, file Form RA-90 with HCR.

What to attach
- Copy of current lease
- Any prior renewal leases (showing you are an in-occupancy stabilized tenant)
- Rent receipts or canceled checks for the past 12 months
- DHCR rent registration history (if available)
Pro tips
- If the landlord fails to offer renewal, you stay in occupancy as a statutory tenant — do not move out, and keep paying the prior rent.
- You may elect a 1- or 2-year renewal. Specify your election in writing.
- Any new "rider" terms imposed at renewal that go beyond NYC RGB increases are unenforceable — § 2523.5(c)(2) requires renewal on the same terms and conditions.
