What this letter will cite
- NYC Admin Code § 27-2029 — Essential services include heat, hot water, water, gas, electricity (where landlord-supplied), elevator, refrigerator, and stove. Interruption is a Class C immediately hazardous violation.
- 9 NYCRR § 2523.4 — A stabilized tenant may file Form RA-81 with HCR to obtain a rent reduction order until services are restored. Reduces rent by guidelines-board increases for the prior year.
- NYC Admin Code § 27-2115 — Tenant may bring an HP action for an order to correct conditions and restore services, plus civil penalties. No filing fee for indigent tenants.
- NYC Admin Code § 27-2115(o) — $50/day per violation up to $1,000 per unit; doubles for repeat violations within 2 years.
